According to report by Nigerian Tribune on Friday, June 26, 2026, Peter Obi’s reported presidential aspirations have encountered a legal hurdle after a Federal High Court in Lokoja nullified its earlier ruling directing the Independent National Electoral Commission (INEC) to register the Nigeria Democratic Congress (NDC).
In a judgment delivered on Friday, Justice Isah Dashen overturned the court’s December 10, 2025 decision, stating that it could not remain valid because all parties with an interest in the matter were not given the opportunity to participate before the judgment was delivered.
The court upheld an application filed by the Peace Movement Party (PMP), which sought to be joined in the case as an interested party.
Justice Dashen ruled that the party had successfully demonstrated that it was a necessary participant in the legal proceedings and should have been heard before any final decision was reached.
According to the judge, the previous proceedings violated the principles of fair hearing guaranteed by the Constitution.
He explained that excluding a necessary party rendered the earlier judgment fundamentally flawed and legally unenforceable.
Justice Dashen further noted that certain material facts were allegedly withheld from the court when the 2025 judgment was obtained.
In view of these omissions and the procedural defects identified, he declared the earlier ruling a nullity and ordered that it be set aside.
To preserve fairness while the dispute continues, the court directed that the status quo be maintained until the substantive case is determined.
It also ordered that the matter begin afresh, allowing all relevant parties to fully present their arguments.
The fresh hearing will now involve INEC, the Nigeria Democratic Congress (NDC), and the Peace Movement Party (PMP) as parties to the suit.
The latest ruling effectively suspends the legal basis upon which the NDC was to be registered, leaving the party’s recognition by INEC unresolved pending the outcome of the renewed court proceedings.
The decision represents a significant legal setback for the party as it seeks official registration ahead of future political activities.
